Virginia Securities Attorneys

Do you have complaints regarding a broker or investment adviser in Virginia? You may be able to collect a recovery. Call the securities and investment fraud law firm Fitapelli Kurta for a free consultation: 877-238-4175.

Fitapelli Kurta represents investors in Virginia and nationwide through two methods: by association with local counsel or through the Financial Industry Regulatory Authority (FINRA). Whereas many other civil complaints are adjudicated in court, most securities claims are decided in binding arbitration before a FINRA panel. Fitapelli Kurta has years of experience championing investors in this setting.

How Are Virginia Investors Protected?

Virginia investors are protected by the Virginia Securities Act and other rules and regulations included in the Virginia Administrative Code. Among other things, the Virginia Securities Act empowers Virginia investors to seek financial redress against investors who have committed fraud or unethical misconduct.

The Virginia Securities Act is enforced by the Virginia State Corporation Commission’s Division of Securities & Retail Franchising. According to its website, the Division “is responsible for the regulation of securities, broker-dealers, broker-dealer agents, investment advisers and their representatives. It is also responsible for the registration of franchises and trademarks in Virginia. The Division answers inquiries, provides investor education programs, handles complaints, performs audits, and conducts investigations regarding code violations relating to securities and retail franchising.”

Despite these powers, however, the Division of Securities & Retail Financing cannot represent investors in arbitration before a FINRA panel, where the majority of securities complaints are adjudicated. Only private securities have this power. Similarly, the Division of Securities & Retail Financing cannot enforce the recovery of damages against a respondent party. Only a court has this power.

These reasons are why it is essential for investors to seek out and retain the services of an experienced securities attorney.
